Assistive Device Lemon
Law
Kentucky
has a special "Lemon Law" to protect consumers who buy
or lease "assistive devices," such as handicap-equipped
motor vehicles, wheelchairs, scooters, talking computers - basically
anything used to make a major life activity easier.
It requires the manufacturer to give a one year warranty,
covering the full cost of any repair or replacement that becomes
necessary. Your only obligation is to return the item to the seller
or the manufacturer and tell them what is wrong. They must either
fix it or replace it.
If they decide to repair it, then they have to give
you a free "loaner" while they are working on the device,
if the repair takes more than 10 days or if you return it for repair
of the same problem more than twice.
However, they only get two chances to get the same
problem fixed and the device can be out of service (in the repair
shop) a maximum of 30 days. If not, then you get to choose between
making them buy it back or getting a new device, minus a reasonable
allowance for your use of it.
